Zimmerman case: Judge denies request for gag order

A Florida judge has denied a prosecutor?s request for a gag order to prevent George Zimmerman?s attorney from posting documents and other information online.

Zimmerman, 29, a former neighborhood watch volunteer, has pleaded not guilty to second-degree murder in the fatal shooting of unarmed teen Trayvon Martin, 17, inside a gated community in Sanford, Fla., on Feb. 26.

Zimmerman claims he shot Martin in self-defense.


In her two-page order Monday, Circuit Court Judge Debra Nelson wrote that she found no "overriding pattern of prejudicial commentary" and noted that a dozen media companies that had opposed the order were right when they argued that the state had failed to demonstrate prejudice.

Assistant State Attorney Bernie de la Rionda had argued that?Zimmerman?s lawyer, Mark O?Mara, has used a website set up to assist Zimmerman and social media sites such as Facebook and Twitter to publicly discuss the case, potentially tainting jurors.

O?Mara denied the prosecutor's claims, saying Zimmerman has faced a ?tidal wave? of inaccurate information.

It was the second time de la Rionda had requested a gag order in the case.

Zimmerman's case attracted national media interest and outrage from critics because police initially declined to arrest him. He is currently free on a $1 million bond and living in an undisclosed location near Sanford awaiting his trial, which is due to begin June 10.

Zimmerman's father is white and his mother is Peruvian; Martin was black.

For Zirita workshops, maestra Benedicta wears typical Pur?pecha dress: elegant knife-pleated skirt, hand-embroidered lace apron, and a beautiful lacy blouse.? She has her rebozo (long rectangular shawl) folded on her head to keep her hands free and as protection from the sun.

This past May, Mexico Cooks! was honored to be part of the opening at Taller Zirita, Cynthia Mart?nez's incredibly beautiful cooking school in Morelia, Michoac?n.? At that time, we were pleased to show you photos of the exquisite environment of a Zirita cooking class.? I'm excited to report that I have now been part of two Zirita culinary workshops, both offered with maestra Benedicta at the helm.

The delightful and talented Carolina Salazar Valle is part of the culinary teaching team at Zirita.? In front of her on the counter, you see the printed recipes given to each attendee, as well ingredients for a few of the dishes that are her part of the day's workshop.

Our list of recipes for each of the days I participated at Zirita included this menu:

  • chiles rellenos de uchepos (Poblano chiles stuffed with sweet corn tamales)
  • corundas (traditional dried corn tamales with swiss chard and carrots)
  • chorizo de Huetamo con salsa de mango (Huetamo-style spicy sausage with mango sauce)
  • col de ?rbol dos maneras (wild cabbage prepared two ways)
  • mole de queso de Benedicta (Benedicta's cheese mole)
  • paquesos (sweets for dessert made of ground wheat and piloncillo [Mexican brown sugar cones])

Our workshop group, divided in two parts, prepared all of these traditional Michoac?n delicacies and then enjoyed platefuls of everything we had prepared as our marvelous comida (main meal of the day).

Maestra Benedicta showed our group how to knead the masa (corn dough) we used to prepare corundas.? The masa is kneaded with grated, aged Cotija cheese, salt, shredded fresh acelgas (Swiss chard), and finely diced fresh carrots.? She said, "Watch and listen.? The masa will speak to you when it's ready to use."? She was right: when she had kneaded the masa enough, it began to squeak as it pulled away from the bottom of the batea (wooden bowl).? We carefully cleaned both sides of long corn leaves (right side of photo), used to wrap the corundas.? Maestra Benedicta told us that there were two different sides to a corn plant's leaf: one side is smooth, the other is fuzzy.? The balls of masa that are transformed by steam into corundas are placed on the smooth side.

Maestra Benedicta wraps a ball of masa into the corn leaf.? Each corunda can have three, five, or seven picos (points) which are formed by the way the corn leaf is wrapped.? It's rare to see a corunda with seven picos, but maestra Benedicta has the necessary wrapping skill.

The corundas are stacked in their clay pot to steam.? The lid will be a clay bowl that fits snugly into the pot opening.? Maestra Benedicta does not use a vaporera (steam pot).? Instead, she places a bundle of very small pine branches at the bottom of this clay pot, then a cushioning layer of the leftover ribs ripped lengthwise from the center of each of the corn leaves, then the water for steaming, then the corundas.? Nothing goes to waste in her kitchen: everything has a use.

Fluffy, hot-out-of-the-pot and freshly unwrapped corundas con acelgas y zanahorias, served with a molcajete-made sauce.? The molcajete is a three-legged volcanic stone mortar which is used with its own volcanic stone tejolote (pestle).

While the corundas steamed in their clay pot, Carolina taught us to make chorizo de Huetamo con salsa de mango.? We ate this dish spooned onto crisp corn tostadas for a simple, spicy, and delicious appetizer.

One group of students prepared col de ?rbol two different ways, cooked (in this photo the potful has just been put on the fire) and as a raw salad with vinegar and crumbled cheese.? Both preparations were magnificent.

One of maestra Benedicta's daughters minds the cooking fire; her own daughter is at her side.? Many traditional Pur?pecha cooks continue to cook outdoors over a fragrant wood fire.? Special long stones form the parangua (sacred cooking area); smaller stones form the fog?n (support for the pot).?

A Pur?pecha girl is never too young to learn ancient techniques: maestra Benedicta's two-year-old granddaughter Imelda has her own miniature metate y mano (grinding stone and rolling pin made of volcanic rock) and is learning to grind corn for masa by watching and imitating her grandmother and her mother.? Maestra Benedicta learned these same techniques from her grandmother.? The Pur?pecha kitchen has always been taught by oral tradition, recipes and techniques passing from grandmother to daughters and from a mother to her own daughters.

Managing small business debt

As a lender, we talk to hundreds of customers both potential and returning every day. Their challenges with debt and credit are often entwined with their particular triumphs as small business owners, but debt does occupy a central place in the average business owner?s mind.

This will not be an article about avoiding debt altogether, but rather about effectively managing that debt. You will have to take some on to get loans, leases and other kinds of lending in order to finance the projects big and small at your business. Companies and people alike need to have debt to maintain the quality of their credit scores, too.

The key to managing your debt is to make payments on time and never bite off more than you can chew. Both of those can be difficult for even the most seasoned small business owner, but here?s a couple of tips for effectively managing debt and not getting yourself into trouble.

  1. Making those payments on time. Be sure to work with lenders to develop a payback schedule that makes sense for your cash flow, and miss as few payments as possible. Whatever you do, do not get caught in a death spiral, making every payment late and falling behind. Once creditors get involved or you?re stumbling and fumbling your way to each payment, you?re going to start to take a hit in your credit score, among other consequences. Which brings us to our second point.
  2. Do not bite off more than you can chew. Yes, as a lender, Direct Capital likes it when we?re able to lend money to small businesses. Our chief concern, however, is helping you grow your business and thrive, not giving you money you can?t possibly afford to pay back. Try to limit yourself to one or two active loans/leases at a time so you can easily manage paying them back, and never take on a bigger loan that you think you can reasonably handle.

Visa hires JPMorgan's Charles Scharf as CEO

(Reuters) - Visa Inc said Charles Scharf, a former head of JPMorgan Chase & Co's retail financial services division, will succeed Joseph Saunders as chief executive, effective November 1.

Visa's board had been looking for a successor to Saunders, 66, who has headed the company since 2007 and was expected to retire soon.

Scharf, 47, previously served on Visa's board from 2007 to January 2011.

Known as Charlie, Scharf was moved from JPMorgan's retail banking business to its private equity arm in 2011, after the lender shuffled several retail banking executives in a push to raise profit.

Scharf worked closely with Jamie Dimon, chairman and CEO of JPMorgan, when the two men were at Citigroup Inc in the 1990s. Scharf followed Dimon to Chicago-based Bank One, which was bought by JPMorgan in 2004.

Scharf is currently managing director at One Equity Partners, which manages $10 billion of investments and commitments for JPMorgan Chase.

"We believe Scharf's large-scale management experience is a good fit ... and our initial checks have been positive regarding his leadership style," Jefferies analyst Jason Kupferberg wrote in a note to clients.

Scharf's experience with JPMorgan will also help Visa. The bank is Visa's largest card issuer and accounts for about 10 percent of its profit, Kupferberg noted.

Scharf joins at a time that Visa, competitor MasterCard Inc, and card-issuing banks are trying to chart their courses through a storm of new digital technologies and companies that have come to the payments industry from outside of banking, such as eBay Inc's PayPal and Square Inc.

Analysts do not expect Scharf to spark major changes at the payment network.

"I think Visa is doing well. I think all he is going to be charged with is moving it forward in the same direction," Wedbush Securities analyst Gil Luria said.

The San Francisco-based company has already raised its full-year earnings forecast twice this year, as more people move to card-based payments globally.

Visa is scheduled to report fourth-quarter results on October 31.

Current CEO Saunders spearheaded Visa's 2008 initial public offering and will continue as executive chairman until March 31, after which Visa will appoint a new non-executive independent chairman.

Visa said Scharf would receive $950,000 per year in base salary and a bonus of up to 500 percent.

Scharf will also get a "make-whole" award of restricted stock and options worth $19 million, the company said in a filing with the U.S. Securities and Exchange Commission. The award is based in part of compensation Scharf is leaving behind at JPMorgan.

Saunders received $11.8 million in total pay in 2011, according to regulatory filings.

Shares of the credit and debit-card network were up less than 1 percent at $137.48 on the New York Stock Exchange on Wednesday afternoon.

Wall St slumps on weak outlooks from DuPont, UTX

fell short of Wall Street's revenue expectations, amplifying worries about the health of the global economy.

DuPont's stock lost 8.8 percent to $45.39 after the chemical company reported lower-than-expected quarterly profit and announced 1,500 job cuts. The stock was responsible for a 33-point drag on the Dow, which was down more than 220 points.

The S&P materials sector index was down 2.8 percent, largely on account of DuPont's performance.

"The market has gone from taking a macro view focused on E.U. and China to focusing on earnings, and the earnings are disappointing," said Timothy Hoyle, director of research for Haverford Investments in Randor, Pennsylvania.

"We expected earnings to be flat to down a few percent, but we did not anticipate the fact that the third quarter got progressively weaker for many companies."

A total of 145 of the S&P 500 companies have reported results so far. Sixty-three percent have missed analysts' expectations for revenue. By contrast, since 1994 an average of 62 percent of companies have exceeded estimates. Over the past four quarters 55 percent of companies have beaten.

The Nasdaq pared losses as Apple cut some of its losses after Chief Executive Tim Cook announced the computer and cellphone company was launching a smaller, cheaper tablet.

Apple Inc unveiled an 8-inch tablet, competing in a market staked out by Amazon.com Inc and Google Inc . Apple slipped 0.9 percent to $629.76.

Elevator and air conditioner manufacturer United Technologies Corp slipped 0.4 percent to $77.55 after its third-quarter earnings fell 3.3 percent.

Overall earnings for S&P 500 companies are expected to fall 2.5 percent in the third quarter from a year ago, Thomson Reuters data showed.

The Dow Jones industrial average was down 216.88 points, or 1.63 percent, at 13,129.01. The Standard & Poor's 500 Index was down 18.17 points, or 1.27 percent, at 1,415.65. The Nasdaq Composite Index was down 13.86 points, or 0.46 percent, at 3,003.10.

In a development reviving investors' worry about Europe, Moody's downgraded five key Spanish regions by one or two notches late on Monday, citing their limited cash reserves and forthcoming bond repayments.

The S&P 500 was below its 50-day moving average of about 1,434, which had been a level of support and may now act as resistance if the market is able to rebound.

A total of 33 S&P 500 companies were scheduled to report earnings on Tuesday, including Netflix and Facebook after the close.

Romney looks to transform momentum into votes

MORRISON, Colo.?Mitt Romney isn't a rock star, but on Tuesday night, he was treated like one.

The Republican presidential nominee attracted nearly 12,000 people?easily one of his biggest crowds ever?at a rally held at one of the most famous concert venues in the country: the Red Rocks Amphitheater built into the Rocky Mountains outside Denver.

The historic open-air venue has hosted some of the more memorable performances in the annals of rock and roll, including a 1983 concert that marked the first time many Americans had heard of a then little-known Irish band called U2.

While Romney did not arrive on stage with the flash and showmanship of Bono, the GOP nominee, who was introduced by his running mate, Rep. Paul Ryan, elicited a reaction from the crowd that could have rivaled those received by any modern day pop star. Packed high into the nosebleed seats running high along the sandstone cliffs that were illuminated by blue lights and the now familiar "R" of the Romney campaign logo, people jumped to their feet and screamed at the sight of the GOP nominee.

"Wow," Romney said, pausing to bask in the glow of a crowd cheering so loud it made his words hard to hear. "What a place this is? This is a magnificent place. For a guy born in Detroit to come here and look at these extraordinary mountains? It's just overwhelming."

The rally capped off a day in which Romney sought to capitalize on what he repeatedly insisted was momentum coming off his three debates with President Barack Obama. Echoing remarks he made earlier Tuesday at a rally outside Las Vegas, Romney insisted his campaign was now "super charged" heading into the election's final two weeks.

"We're in the homestretch now, and I think the people of Colorado are going to get us all the way there," Romney said, imploring supporters in this key battleground state to vote early and to convince others to give his campaign a chance.

Not unlike other recent speeches, the GOP nominee went out of his way to play up his history of working with Democrats as governor of Massachusetts and pledged that, if elected, he and Ryan would seek out "good Democrats and good Independents" willing to work to change Washington.

"We're going to have to have a real change. The president said he was a president of change," Romney said. "But in fact he's become a president of status quo. And the policies of the president are a continuation of what we have seen over the last four years."

But it's unclear how Romney's message of bipartisanship went down with the audience. Just before Romney took the stage, New Mexico Gov. Susana Martinez spoke about the need to turn the country around?and told supporters that the GOP's push to unseat Obama wasn't personal.

She praised Obama as a man who loves his family and his country?a comment that elicited loud boos from some in the crowd.

On Wednesday, Romney heads back to Nevada, where he'll hold a rally in Reno, before heading to Iowa and then to Ohio.

17th Century Microscope Book Is Now Freely Readable

Yep, I don't understand why this is news, and why that book hasn't been available electronically for a long time.

Probably some jerk-publisher fraudulently claimed "coypright" on its print of it, and it took google several years until they noticed that indeed, the publisher did NOT have a copyright, and indeed, they COULD post it in its entirety. Which is, by the way, why around 80% of all public domain books google has digitized are not available in its entirety.

He's a writer and "media inventor" which seems to be a lofty term for "cool guy who gets the Internet and understands that discourse needs to be both intelligent and entertaining to effect any sort of meaningful social change." He also writes a damn good intellectual thriller, if you're into that sort of thing.

Yelp Slaps Consumer Alerts On Business Pages For Those Who ...

Yelp announced today that it is now showing warnings to users when they have found businesses that have paid for reviews. If you are looking at such a business on the site, you?ll be greeted with a ?Consumer Alert?. This comes with a message that says:

?We have caught someone red-handed trying to buy reviews for this business. We weren?t fooled, but wanted you to know because buying reviews not only hurts consumers, but also honest businesses who play by the rules. Check out the evidence here.

Yelp will remove the alert from the business? page after 90 days, unless they find more efforts to mislead consumers. Yelp indicates that nine businesses will have the alert showing up at launch, but it will appear on any other pages for businesses Yelp finds to be in violation.

Yelp says its automated review filter is ?working around the clock? to flag these kinds of reviews.

Eric Singley, Yelp?s VP of Consumer Products and Mobile, says, ?As efforts to game the system continuously evolve, so do our methods for combating it. An independent Businessweek report confirmed the success of Yelp?s efforts to protect consumers. The article details the efforts of a Texan business owner who purchased 200 online reviews in an attempt to artificially bolster his business?s online reputation. The report found that Yelp?s review filter returned ?impressive results? catching every purchased review, while the shill reviews remained up on seven other review sites.?

?Beyond alerting consumers to attempts to purchase reviews, the next step will be to let consumers know if a business has had a large number of reviews submitted from the same Internet Protocol (IP) address, which can be a helpful indicator that they lack authenticity,? he adds. ?While the review filter already takes this type of information into account, we believe that consumers also have a right to know if this activity is going on.?

He does reassure users that most businesses on Yelp are playing by the rules.

Ballack facing fine, driving ban for speeding

TRUJILLO, Spain (AP) -Former Germany captain Michael Ballack could lose his license plus face a fine of ?10,000 ($13,000) after being caught speeding on a Spanish highway.

The former Chelsea and Bayern Munich player appeared in court in Trujillo to challenge the charges on Thursday, a day after being clocked at 211 kph (131 mph) in a 120 kph (75 mph) zone.

"He didn't speak in court, he didn't want to say anything," lead prosecutor Eliseo del Blanco Diaz told The Associated Press by telephone.

Ballack, who retired from football this month, doesn't need to appear at sentencing on Oct. 31.

Ballack faces a fine that amounts to paying ?30 ($40) per day across 11 months. He could lose his license for two years, six months, although that penalty can be enforced only in Spain and will be up to local authorities in the rest of Europe, Del Blanco Diaz said.

Ballack made 98 appearances for Germany, helping it to the 2002 World Cup final and 2008 European Championship final. He retired this month when Bayer Leverkusen did not extend his contract.

Growing up, I spent nearly every summer at my grandparents? small farm in the mountains of eastern Kentucky.?

My mother grew up on the same farm.? When she was a girl, Acup Creek, the small mountain creek that runs through the farm and is a tributary of the Kentucky River, was filled with crayfish and minnows and was an aquatic playground for Mom and her siblings and cousins.?

By the late 1960?s and early 1970?s, when I was a kid, Acup Creek was nearly dead, polluted by acid mine drainage from surrounding coal mines as well as raw sewage from inadequate sanitation facilities for the homes along the creek.? I remember feeling cheated that, because of this pollution, I couldn?t play in the creek as Mom had done.

With the advent of the Clean Water Act in 1972 and other federal environmental laws, Acup Creek began to be cleaned up.? The coal mines could no longer simply allow their toxic waste to flow into the creek. Modern water supply and sewer lines were installed in the area.? ?

As a result, Acup Creek is again alive with fish and other aquatic creatures.? And while no one in my family lives on the farm today, a part of me will always be there.? Consequently, it gives me great satisfaction to know that, as a result of the commitment we made as a nation 40 years ago to make our rivers and streams fishable and swimmable again, Acup Creek and rivers and streams across the country have been restored to health. ?

Moreover, if our parents and grandparents were wise enough to join in this commitment, surely we can be just as wise in maintaining and strengthening the commitment to clean, healthy rivers for generations to come.

HBT: Decision to pull Verlander pays off for Leyland

Sending Justin Verlander back out to pitch the ninth against the Yankees with a 2-0 lead in Tuesday?s Game 3 was pretty much a no-brainer. It?s not like manager Jim Leyland was going to turn to Jose Valverde. 115 pitches is a pretty high total to be starting an inning with, but Verlander has been there before.

At that point, the ideal would have been for Verlander to finish his two-hit shutout at 125-130 pitches. The Yankees, of course, refused to go quietly in the ninth. Eduardo Nunez battled for eight pitches and then sent a hanging curve over the wall in left. 124.

Brett Gardner didn?t reach, but he too extended the reigning AL Cy Young and MVP. He tapped out to Verlander on the eighth pitch of the at-bat. 132.

That total tied Verlander?s career high for a regular season outing. He threw 132 pitches in 7 2/3 innings against the Red Sox on May 29, 2011 and again in striking out 14 Yankees in eight innings on Aug. 6 of this year. In all, he?s had four regular-season outings of 130 pitches, 20 of 125 or more and 47 of at least 120.

Verlander?s career high for a postseason start was 133 pitches in Game 5 of the 2011 ALCS against the Rangers. He also came in at 121 and 122 in his two starts against the A?s in the ALDS earlier this month.

So, letting Verlander carry on in the ninth would have put him into uncharted territory. And the truth is that Verlander wasn?t at his best in this one, even as he was racking up zeroes against the Yankees. He struggled all night to get ahead of hitters, and the fact that it took him 17 pitches to get one out of the ninth suggested he was done. That Phil Coke had pitched so well in the series and that the Yankees lineup was stacked with lefties made it an easier call for Leyland.

And Verlander didn?t seem broken up about it after the game. While he suggested he would have preferred to carry on, he also talked about how saving him for the rest of the postseason was important.

But I don?t think that was it. I think Leyland saw those last two at-bats against Verlander and thought Coke was his best option to get those final two outs. Otherwise, it probably would have been Verlander and that 140-pitch barrier be damned.

All worked out in the end, though not before Coke made things very interesting by giving up a pair of singles. Now it all goes well from here, Verlander will make his next start on seven days? rest in Game 1 of the World Series.

Round two over, Obama and Romney back to campaign trail

WASHINGTON (Reuters) - Fresh off a feisty debate that re-energized Barack Obama's bid for a second term, the Democratic president and Republican rival Mitt Romney headed back on the campaign trail on Wednesday to start their final appeals to undecided voters.

With 20 days to go until the November 6 election, the candidates' vice presidential running mates blanketed the morning television talk shows to claim victory in the second U.S. presidential debate on Tuesday evening.

Romney's partner, U.S. Representative Paul Ryan, said Obama failed to lay out a convincing plan for economic recovery.

"The president ... couldn't justify his record on deficits and job creation. And what Mitt Romney offered was a very specific plan on how to get the country growing and creating jobs again," Ryan said on ABC's "Good Morning America."

Vice President Joe Biden, whose aggressive strategy in his own debate with Ryan last week set the tone for Tuesday's Obama-Romney matchup, said the president "had a great debate."

Romney, however, remained woefully short on details, especially about his pledge to lower taxes for the middle class while not adding to the federal budget deficit, he said.

"Even after three debates ... there is still not a single specific in the Romney $5 trillion tax plan. Everything is sketchy," Biden said on NBC's "Today" show. "There's no direct answers to any questions, and I think it's becoming clearer and clearer to the American people that there's a fair amount of rhetoric but not much substance."

Obama made up for a much-criticized listless showing in the first presidential debate two weeks ago, attacking his millionaire opponent over economic proposals he said would bolster the wealthy at the expense of the middle class.

Greg Valliere, political strategist at Potomac Research Group, said Obama scored points while Romney missed some opportunities.

"Barack Obama, trailing by 4 points in yesterday's Gallup poll of likely voters, needed a great debate last night, and he got a very good one," Valliere wrote in a memo to clients. "Obama stopped his free-fall, and he probably will be tied again in polls by this weekend."

Valliere and other analysts said Romney bungled on foreign policy when he mischaracterized - and was corrected by the debate moderator - Obama's initial remarks on last month's deadly attack on diplomatic facilities in Libya.

Instead, Obama took advantage of the moment to accuse Romney and Ryan of politicizing the event that killed four Americans, including U.S. ambassador Christopher Stevens.

Obama travels to Iowa and Ohio and Romney holds campaign events in Virginia on Wednesday. All three states are considered "swing states," with polls showing they could go to either candidate in the presidential election.

ECONOMY FOCUS

Instant polls after the debate gave the edge to Obama.

But Romney, a former private equity adviser who says his business experience will help him turn around the U.S. economy, scored points when he accused Obama of failing to follow through on promises of his 2008 campaign.

In one of his most effective moments of the debate, the former Massachusetts governor said Obama's poor economic record had led to 15 million more people on food stamps, slow growth and a lack of jobs.

The debate's impact will not fully emerge for a couple days. Romney enjoyed a surge after his first matchup with Obama on October 3, but the latest opinion polls show the presidential race is near a dead heat.

Tuesday's Gallup poll had Romney ahead by 4 percentage points in the 12 most contested states, while the daily Reuters/Ipsos tracking poll shows Obama in the lead by 3 points among likely voters across the country.

The Tuesday Reuters/Ipsos poll also showed more likely voters have moved away from one of the candidates and declared themselves "undecided."

The two candidates were clearly seeking the female vote in the debate on Tuesday night, but Romney stumbled over his words as he explained how he supports equal opportunities for women.

He said while he was Massachusetts governor he once had "binders full of women" candidates for cabinet jobs - an awkward phrase that prompted a flurry of reaction on social media. The claim also raised questions about whether influential women were part of his circle while he was governor.

Republican National Committee chairman Reince Preibus said on MSNBC that Romney was just trying to emphasize that women are a big part of his administration.

The pair meet again on Monday in Boca Raton, Florida, for their final debate, which will be on foreign policy.

Ancient, fossilized, insect-like brain surprisingly complex

The fossilized brain, found in an extinct arthropod from China, looks very similar to the brains of today's modern insects.

The oldest brain ever found in an arthropod ? a group of invertebrates that includes insects and crustaceans ? is surprisingly complex for its 520-million-year age, researchers report today (Oct. 10).

The fossilized brain, found in an?extinct arthropod?from China, looks very similar to the brains of today's modern insects, said study researcher Nicholas Strausfeld, the director of the Center for Insect Science at the University of Arizona.

"The rest of the animal is incredibly simple, so it's a big surprise to see a brain that is so advanced, as it were, in such a simple animal," Strausfeld told LiveScience.

The discovery suggests that brains evolved a complex organization early on in history, he added.

The evolving insect brain

Arthropods include any animal with an exoskeleton, jointed legs and a segmented body, from lobsters to scorpions to beetles to butterflies. There is controversy about how these various creatures evolved, however. One theory holds that insects evolved from ancestors not unlike today's branchiopods, which are extremely simple?crustaceans?such as fairy shrimp and water fleas. Branchiopods have simpler brains than insects and higher crustaceans, Strausfeld said, so this theory of evolution holds that both higher crustaceans and?insects?evolved very similar complex brains after splitting off from this common branchiopod-like ancestor. Alternatively, all of these groups ? insects, branchiopods and higher crustaceans ? could have evolved from an ancestor with a complex brain, with branchiopods regressing later.

"So the question was, 'What was the early brain, what did it look like? Did it look simple or did it look complex?'" Strausfeld said.

That's not an easy question to answer, given that?brains rarely get fossilized. But Strausfeld's earlier work on arthropod fossils convinced him it could be done. He just had to go to China, home of an amazing collection of stunningly preserved ancient fossils.

Last-minute discovery

In China's Yunnan province, paleontologists have long uncovered fossils from the Cambrian period, which ran from about 542 million to 488 million years ago. These fossils are very well-preserved.

For five days, Strausfeld and his colleagues poured through fossils, searching for dark silhouettes of preserved brains inside ancient arthropod heads. There was one fossil that remained elusive, however: A specimen Strausfeld had read about in a paper by Swedish researchers. They thought they'd seen a fossilized brain.

With only a few hours left in the lab, Strausfeld's colleague, Xiaoya Ma, of the Natural History Museum in London went hunting for the missing specimen. An hour and a half later, she returned with the fossil, an extinct armored creature just a few centimeters long called?Fuxianhuia protensa. [25 Amazing Ancient Beasts]

"I looked at the microscope and I think I said something like, 'Whoopee, I think we've got the crown jewels!'" Strausfeld said. Under magnification, he could see the dark brown silhouette of preserved brain nestled in the arthropod's skull.

"It's pretty bloody marvelous, actually. ? I was sitting looking at the thing, going, 'Oh my goodness gracious,'" Strausfeld said. With only five hours left before he had to leave to give a scheduled talk and fly home, Strausfeld got busy photographing the discovery.

An analysis of the brain revealed it to be in three parts, just as the brains of modern insects are in three parts (known as the protocerebrum, deutocerebrum and tritocerebrum). Nerves from the eyes extend into the protocerebrum, nerves from the antennaes feed into the ancient creature's deutocerebrum, and a third nerve root from further back in the body extends into the tritocerebrum. The researchers report the findings in this week's issue of the journal Nature.

This complex,?insectlike brain?suggests that rather than insects arising from simple branchiopods, today's arthropods descend from a complex-brained ancestor. Branchiopods would later have shed some of this complexity, Strausfeld said, while other crustaceans and insects kept it. In fact, he said, the brain may have evolved to segment into three parts very early on; mammals, including humans, have a?forebrain, midbrain and hindbrain, suggesting a common organization.

"Lots of people don't like that idea, sharing a brain with a beetle, but there's good evidence suggesting that you do," Strausfeld said.

Bug brains may seem simple to us, but arthropods are at the base of many a food chain, making them crucial creatures, Strausfeld said. He and his team plan to return to China to hunt out more ancient arthropod brains.

"What we want to do, of course, is go deeper in time," Strausfeld said.
